Livro: "SOCIOLOGIA DO CAMPO JURÍDICO: JURISTAS E USOS DO DIREITO"

The present work intend to carry through a sociology of Brazilian legal field of the 90s. With this purpouse, it was investigated the relation between the diversification of legal space and the legitimation of definitions of Law in Brazil during the 90s. It was analyzed the narrow correspondence between the differentiation of the teaching of Law as place of production of definitions of legal problems and the mobilization of determined uses of Lawyering and careers of State, in this period. The analyzed empirical universe was the space of the jurists of Rio Grande do Sul. The work is divided in five parts. In a first one, it is carried through the definition of the analyzed problematic in relation with the existing studies on the research subject. In one second, it is analyzed the configuration of the legal tradition heiress of the standard of the imperial bacharelismo inside the analyzed space and its relation with the catolicism and the social, professional and politics insertion of the main agents associated with this tradition. In one third part, it was analyzed the differentiation of a space of production of definitions of Law related to the ascension of determined groups of “marginalized” jurists that turn against this tradition. Outstanding resources of these are the investment in Master’s and Doctoral degrees, the professionalization in the teaching activity and in the definition of institucional criteria of legal education. In one fourth part, it was analyzed the mobilizations of new uses of Law in the world of legal careers through the movement of the “alternative Law” and the analysis of representative cases of Law engaged in collective causes. Finally, in a fifth part, it was broached the emergency of associations of jurists, particularly of magistrates and prosecutors, and the mobilization around institucional definitions and legitimation of these careers face the world of politics. This set of dimensions allowed to apprehend determinants referring to the internal fights of the analyzed universe, as well as the repositioning of jurists in Brazilian space of power in the 90s.
